ORDINANCE
NO. 2003-05-02:
AN
EMERGENCY ORDINANCE ESTABLISHING RATES TO BE HENCEFORTH CHARGED USERS OF
THE WATER AND SEWAGE SYSTEMS OF THE VILLAGE OF NEW WATERFORD, OHIO.
BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF NEW WATERFORD, COUNTY OF
COLUMBIANA, STATE OF OHIO:
Section
One:
The rate to be henceforth charged the users of the Village water
system and sewer system shall be as follows:
A.
For
customers who have both water and sewer services:
1. SEWER RATE
$20.50 monthly base rate plus $ 3.10 per 1,000 gallons of water
used.
2. WATER RATE
$10.00 monthly base rate plus $6.00 per 1,000 gallons of water
used.
B.
Sewer users who do not have water furnished by the Village of New
Waterford shall be charged
a
base rate of $17.50 plus the amount of the average charge for water to
residential customers.
C.
Water
users who do not have sewer furnished by the Village of New Waterford shall be
charged a base rate of $13.00 plus
$6.00 per
1,000 gallons of water used.
D.
That
users found to discharge high strength waste water will be charged an
additional fee for added costs of handling the unusual waste and the same
shall be as follows:
5 day Biochemical
Oxygen Demand (BOD5) surcharge of $0.262 per pound of BOD5.
Suspend Solids (SS) surcharge of $0.166 per pound of SS.
Section Two:
Said charges shall be billed to the users of said system on a monthly
basis and said charges shall be paid by the users of said system by the last
business day of the month, otherwise, there shall be a penalty amounting to
Ten percent (10%) of the subject bill, and said penalty shall be charged upon
subsequent billings until the same shall be paid in full.
All such billings and penalty charges shall be subject to collection by
means of certification upon the users tax duplicate pursuant to the provisions
of the Ohio Revised Code.
Section
Three:
THAT all other ordinances, resolutions, or orders, or sections,
sub-sections or parts thereof which may be in conflict with the provisions of
this Ordinance shall be and are hereby repealed to the extent of such
conflict.
Section
Four:
THAT, in the event any portion of
this Ordinance shall be found by a Court of competent jurisdiction to be
invalid or unenforceable, the invalidity or unenforceable thereof shall not
affect the remaining provisions of the Ordinance which shall remain in full
force and effect.
Section Five:
THAT this Ordinance is hereby declared to be an emergency measure
necessary to the preservation of the health, safety, peace and general welfare
of the Village of New Waterford and the inhabitants thereof so that users of
the water and sewage systems of the Village of New Waterford will be billed
correctly and as such this Ordinance shall take effect and be in full force
and virtue upon passage with the terms hereof .
